合并仲裁问题初探

在国际商事纠纷日渐复杂的背景下,合并仲裁作为解决多方当事人争议的一种方式,逐渐引起仲裁实务界和理论界的关注。在双方之间签订有多个合同而发生争议的情况下,也存在合并仲裁问题。考察商事仲裁的实践,应当对合并仲裁加以提倡,支持合意合并仲裁,对非合意合并仲裁予以有限支持,并在仲裁法中对合并仲裁制度加以规定。

A Study of Consolidated Arbitration

The article holds that consolidation of arbitration has its merits and should be promoted. After examining the extent to which courts and arbitral tribunals may order consolidated arbitration of related arbitrations under foreign law,the article gives suggestions about how and to what extent consolidation of arbitration should go without the consent by all of the parties of the contracts at issue.
