行政复议是行政法上的一项重要制度.行政复议的权力性质是行政复议理论问题的核心,对完善我国的行政复议制度具有重要的指导意义.关于行政复议权力性质的各种不同学术观点,并指出了它们的局限性,以孟德斯鸠的理论、权力分立的目的和现代行政权扩张为视角,分析指出行政复议的权力属性为行政权,但为了有效达到设立行政复议制度的目的,保证依法行政,行政复议权在运行过程中,必须以司法权的运行模式为模版.

Research on the Nature of Administrative Reconsideration Power
