论违法性要件的独立及其实现

违法性的含义和功能不同于过错,有其独立的存在价值,故自罗马法以来就以不同方式存在于各国民法上。违法性要件的独立设定,可以克服一般条款解释适用上的困难,有利于自由保障和权利救济双重价值的综合平衡,有助于广泛保护各种民事权利和法益,可以为正当化事由及无过错责任提供理论依据。违法性的判断标准具有一定的弹性,判断方法宜采取＂行为不法说＂。我国侵权责任法规定了违法性要件。
