| Abstract: | As an important part of Chinese traditional culture of politics and law, the legal ethic theory of the Confucianism has had great impact on both rule of law and rule of virtue in modern China, especially on the construction of China's modern legal culture. The impact must not be ignored in the least degree. Thus the legal ethic theory of the Confucianism should be cleared up, valued and sublated before we decide whether it is consultable or functions as an obstacle in the building of our new legal culture. |
