| 摘 要： | 中国传统法律在思想和制度上都有着鲜明的特点,是中华文明的重要组成部分。中国特色的天道、人道哲学观决定了中国传统法律的道德属性、伦理属性等特征。在大力倡导依法治国和精神文明建设的今天,现代中国法律汲取中国传统法律中的合理因素也是非常有必要的。

| Abstract: | China’s traditional law,an important part of Chinese civilization,has vivid feature on both ideology and system.The philosophic concepts of order of nature and order of man with Chinese characteristics determine the features of China’s traditional law such as moral attribute and ethical nature.It is necessary for modern China’s law to draw in the legal factors of China’s traditional law with further advocacy of ruling the state by law and building spiritual civilization today |
