| 摘 要： | 一物一权原则是大陆法系国家物权法的基本原则,也应成为我国物权法的一项基本原则。一物一权原则反映了物权支配性的本质特征,是物权排他性效力的前提,不能为后者所替代。在物权法没有规定具体的规则时,一物一权原则可以作为裁判的依据,以正确解释和适用物权法。
