| 摘 要： | 我国再审程序,制度设计的宏大理想与不尽如人意的司法现实之间存在着巨大反差,再审理念与具体程序设置上的不科学使得再审无限、终审不终,司法裁判无权威性可言;再审程序的改革与完善可以从理念的再塑和制度的重构两方面着手.

| Abstract: | There is a huge gap between the grand ideal of system design and the judicial reality in the retrial system, and the unscientifical installation of the retrial reason and the concrete program makes the retrial and the last retial endless, furthermore, the judge has no any impressive strength; the reform and the perpfect of retrial system should take act on both the remodeled reason and the reconstructed system. |
