| 摘 要： | 在法治建设中,法律结构是一个非常重要的问题,是法治建设的逻辑起点。法律结构的界定不同决定了我们法治建设的发展模式的不同。从法律结构角度进行考查,我国的历史上形成的乡土社会是一种国家法与民间法并存的法律二元结构,我们应该在法律二元结构模式下进行法治建设。

| Abstract: | Being the logical starting point,legal structure is extremely important in the construction of ruling-by-law.Different definitions of legal structure determine various development models of ruling-by-law construction.Studied from the angle of legal structure,the rural society which formed in our country's history is a dual legal structure in which the state law and folk law co-exist.We should carry out our ruling-by-law construction based on the model of dual structure. |
