招安"民间刑事悬赏"整合刑事悬赏制度

在我国,刑事悬赏制度虽然已经有法可依,但存在单一化启动的缺陷,实质上是"依职权式刑事悬赏";公民个人刊登悬赏通告缉拿凶犯,即"民间刑事悬赏",是新近出现的现象,它具有双重属性,需要建立合理的配套制度方能发挥其优良的效用.把握两者的结合点,融合"民间刑事悬赏"与"依职权式刑事悬赏",建立具有"依职权"和"依申请"二元启动模式的刑事悬赏制度,应当是我国刑事悬赏制度改革的方向.

Regulating Criminal Reward of Folks and Integrating the System of Criminal Reward

In China, though the system of criminal reward has a legal basis, it has the defect of simplistic startup. In essence, it is the criminal reward based on authority. Individuals reward for capture of criminals, called criminal reward of folks, is a new thing which has dual attributes, and needs reasonable system to exert. Considering their advantages, putting the criminal reward based on authority and criminal reward of folks together, establishing a dual startup model including based on authority and based on application, it is the direction of the reform of the system of criminal reward.
