民事执行若干问题思考

民事执行程序是国家运用公权力实现已经确定的私权的过程，具有很强的国家强制性，而在执行过程中，种种情形会导致执行阻碍或者侵犯执行当事人及第三人的合法权利。我国现行的民事诉讼法对执行进行了较大幅度的修改，具有很大的进步之处，但仍然存在着不足的地方。文章从执行异议、执行联动机制及财产申报制度入手，试图寻找一些改善途径。

During the process of implementation, the implementation will be blocked by many kinds of situations or tort someone＇s legal rights. The implementation was amended in the current civil procedure law. While there are shortages exists in this law. The article tries to find some ways to promote from the opposition to implemenration,linkage mechanism and declared property institution.
