| 摘 要： | 在民事诉讼法学理论中,上诉是一个重要的法律概念。如何界定上诉,关系到当事人的上诉权的有无和实体权利受保护的程度。上诉涵义的准确诠释是完善我国民事上诉条件的基础。我国现行民事上诉条件存在宽泛化的缺陷,有修正的必要,本文以上诉利益为视角提出完善我国民事上诉条件的构想。
