| 摘 要： | 上海在未成年人保护立法中更多地从社会集体本位出发,主要视未成年人为被保护的对象,而发达国家更多地从未成年人个人权利本位出发,在视未成年人为被保护对象的同时,也突出强调其与成年人一样具有同等的权利主体地位。
