| 摘 要： | 现行《医疗事故处理条例》和《最高人民法院关于审理人身损害赔偿案件适用法律若干问题的解释》对医疗损害赔偿标准的规定各有其不足,应在二者基础上,充分考虑医患双方及社会整体利益,大胆探讨,合理取舍,构建一个兼顾各方利益、能实现普遍社会公正的医疗损害赔偿标准。

| Abstract: | Present regulations of the compensation standard for medical injury in The Regulation on Handling Medical Accidents and Interpretation of The Supreme People's Court of Some Issues Concerning The Application of Law for the Trial of Cases on Compensation for Personal Injury are not perfect.Therefore,a new compensation standard which can make popular social justice come true should be established on the basis of the both,taking account of the benefits of hospitals,patients and the society. |
