民事诉讼认证制度中若干问题之再思考

民事诉讼认证是在我国民事审判方式改革过程中提出来的。它必须建基于辩论主义原则之上 ,其内容为对证据资料的证据能力和证明力 ,采取现代自由心证的方法 ,当庭认证 ,同时还必须建立法官严格甄选、独立审判、认证公开、认证异议和科学周密的证据规则等制度予以保障。

Several problems of Attestation System in Civil Litigation

The civil litigation attestation is put forward in the course of reforming the civil judicial styles in China. It should be based on the doctrine of adversary and its content is to attest in court evidentiary material by applying the modern discretional evaluation of evidence method. Meanwhile it is necessary to build up some rules such as strict selecting lawyers mechanism, separate trial, public attestation, attestation opposition and scientific evidence rules to guarantee it.
