PUA教程中的"自杀鼓励"行为具有严重社会危害性,对其进行法律规制迫在眉睫。但对其如何定性,理论界和司法实务学界尚无确切结果。自杀行为本身具有违法性,"自杀鼓励"可细化为帮助自杀和教唆自杀行为,这两种行为均具有可罚性,其构成犯罪,应当以故意杀人罪论处,无需对此单独设立罪名。

However,there is no definite result on how to define it in the academic circle and the judicial practice. Suicide itself is illegal. Suicide encouragement can be divided into aiding suicide behavior and abetting suicide behavior. Both are punishable and constitute crimes, which should be treated as murder, without the need for separate charges.
