司法所社区矫正国家工作人员探讨

《社区矫正法》对社区矫正国家工作人员提出的专门化要求,有助于其职业特点的规范塑造及职业保障。但全流程参加社区矫正工作的司法所之法律定位仍然模糊,司法助理员的矫正专职性很难保障;从监狱或戒毒所借调或抽调参与社区矫正的干警,稳定性尚显不足。应当给予在司法所从事社区矫正工作的司法助理员和监狱、戒毒所干警以社区矫正专门国家工作人员的法律定位,增加专司社区矫正工作的政法专项编制,以增强社区矫正工作力量;提高社区矫正官的资格准入与薪酬待遇,夯实职业稳定性,并在未来制定统一的《刑罚执行法》。

On the Issues of Community Correction Officer in Local JudicialA dministration

Community Correction Law puts forward the requirement of specialization for community correction officer which helps to shape the professional characteristics of community correction officer and their professional guarantee.However,the legal status of local judicial administration who participates in the whole community correction workflow is still ambiguous,local judicial civil servant’s full time work for community correction is hard to ensure,and the prison police officers who are borrowed to work for community correction is lack of stability.It is proposed that both local judicial civil servant and prison police officer who work for community correction be clearly defined as community correction officer;that the number of local judicial civil servant be increased in order for them to specialize in community correction full time;be of high salary for the sake of professional stability enhancement,and a future corrections law is expected to integrate community and prison correction.
