| 摘 要： | 传统民主理论在强调“多数人统治”的正当性时没有摆脱统治理论的影响,造成了人民主权说与多数人统治之间的矛盾,影响了人民主权说的制度化。现代民主观应当是“社会自治观”,即所有的个体都在社会共同体中以某种方式参与政治决策的过程中,对社会共同体的政治决策产生一定意义上的意志影响作用。这种社会自治观实际上是现代宪政的核心理念。

| Abstract: | When emphasizing the justice of majority ruling,traditional democratic theories did not shed off the influence of the ruling theory so it caused the contradiction between popular sovereignty and majority ruling and affected the institutionalization of the former.Modern democracy should be viewed as social autonomy,i.e.,all individuals in the social community take part in political decision and give their will on the political decision in the community.This kind of social autonomy is actually the essential of modern constitutionalism. |
