| 摘 要： | 我国四要件的犯罪构成理论体系及大陆法系三阶段式的犯罪构成理论体系都有其利弊。文章从评析这两种犯罪构成理论体系出发 ,并以犯罪客体为主考察了我国犯罪构成四要件 ,进而将我国的四要件说与德日三阶段说进行整合 ,提出完善我国传统犯罪构成体系的观点

| Abstract: | Both our country's four-element crime constitution theory and continental law system's three-stage crime constitution theory have its advantage and disadvantage. The article analyses the two theory systems, investigates our country's four-element crime constitution from crime object, then combines our country's four-element crime constitution with three-stage crime constitution, puts forward views on improving our country's traditional crime constitution theory system. |
