| 摘 要： | 我国如果按照所有制的性质划分所有权的类型,违背大陆法系的一惯做法即按不动产与动产的区分来划分所有权类型的做法。如果在物权立法中所有权的类型按生产资料所有制性质划分,人为地划分所有权的高低贵贱,必然不适应社会主义市场经济的要求,不能反映社会主义市场经济的本质。

| Abstract: | If we group the ownership type according to character of ownership system, we will betray the consistent practice of legal system in mainland, which group the ownership by the difference between real estate and movable property. If it is grouped according to the character of the productive material ownership in estate ownership legislation, and the ownership is classified artificially into high and low, noble and humble, it cannot adapt for the demand of socialist market economy and cannot reflect the essence of socialist market economy. |
