摘    要:笔者以社会性别视角检视关于退休年龄改革的“四步”方案、“小步渐进”方案、“分步推进”方案和“柔性退休”方案,发现其中存在对性别平等的忽视和误解,阐述了退休年龄改革的首要目标、理念和立法技术。提出“双轨制弹性退休”方案,以消除性别歧视为首要目标,兼顾不同岗位男女职工的需求及利益期待差异,尊重其在满足工龄或者缴费底线的前提下选择提前退休的权利,同时考虑就业和养老保险基金支付压力加剧的现实,设置自愿弹性退休制与强制性退休制相结合的退休年龄制度。
