| 摘 要： | 从表面上看,行政立法的内容是“管理法”,但透过背后的利益关系看,行政法是“权利法”。要消除法律条文所带来教条 式的影响,必须改革和完善国务院立法的权限和范围,克服行政立法中的部门主义,加大行政相对人权利保护的程序性规定,并严格 行政行为的程序性规定。
