| 摘 要： | 沉默权是国际人权法上的一项基本人权。构建沉默权制度,是刑事讼诉中保障犯罪嫌疑人、被告人人权的必然要求。我国应顺应国际趋势、借鉴两大法系有代表性国家的做法,并结合我国的实际情况,建立适应我国国情的有限沉默权制度。

| Abstract: | The right to silence is a fundamental right in international human rights law, and to build this right system is an inevitable requirement for the protection of criminal suspects and defendants of human rights in criminal litigation. So we should follow the international trend, drawing on the Two Legal System＇s representative practice, and combining with China＇s actual situation to establish a limit right system which can adapt to our national conditions. |
