无证驾驶交强险保险赔付法律问题之研究

对于无证驾驶交强险赔付责任,在司法实践中法院判决颇不一致,根据我国相关法律规定此种责任为垫付责任。但是在垫付范围上,是仅垫付抢救费用,还是限额范围内都具有垫付义务并不清晰,无证驾驶仅应垫付抢救费用应该符合法律的真意。

The court judgment in the judicial practice is quite inconsistent about insurance compensation responsibility for driving without a license, according to China＇s relevant laws and regulations, such liability is called payment responsibility. However, on the scope of advances, it is not clear to only pay in advance for saving cost or limited range, driving without a license shall be paid in advance only rescuing expenses, which should conform to the real meaning of the law.
