比较视野下的媒体监督与刑事裁判之关系构建

媒体作为我国刑事裁判权外部监督的重要载体,对司法运行的监督发展尤为迅速。媒体为了对刑事裁判权进行有效监督而夸张发布一些新闻报道却适得其反。媒体的肆意报道破坏了刑事裁判权的独立性,由此带来了诸多负面效应。媒体监督刑事裁判,有利于提高刑事诉讼的透明度、有利于刑事司法权的独立以及有利于抑制刑事司法权的滥用来防止司法腐败,最终达到保障人权的目的。通过对英、美、德媒体监督与刑事裁判权之关系的域外考察,提出媒体应当加强自身机制监督,同时法官和公众各自加强自身监督机制的构建,进而达到媒体与刑事裁判权协调。

The Construction of Relationship Between Media Monitoring and Criminal Judgment Under Comparative Perspective

As an important carrier of criminal jurisdiction outside oversight, the development of media supervision over judicial practice runs particularly fast. In order to effectively supervise the criminal jurisdiction, media exaggeratedly release some news reports but turned out to be the opposite to their wishes. Media＇s wanton report has resulted in damage to the independence of criminal jurisdiction, which brought about many negative effects. Media monitoring criminal judgment will help improve the transparency of the criminal proceedings, in favor of independence criminal jurisdiction, and help to curb the abuse of the criminal jurisdiction of the criminal justice authority to prevent judicial corruption, and ultimately achieve the purpose of protection of human rights. Through the relationship between the British, American, German media monitoring and extraterritorial criminal jurisdiction of the investigation, media should be strengthen their mechanisms for monitoring, while the judges and the public to build their own strengthening oversight mechanisms, and thus achieve coordinated media and criminal jurisdiction.
