| 摘 要： | 随着法学的不断发展,合同法和侵权法相继独立,一种常见的民事责任竞合类型——违约责任与侵权责任的竞合——也应运而生。违法行为的复杂多样的特点在其身上体现得淋漓尽致,反映了合同法与侵权既法相互独立又相互渗透,相辅相成。

| Abstract: | With the continuous development of law, contract law and tort law have been independent, a common civil responsibility types---the concurrence of liability for breach of contract and tort alsoemerge a s the times require. Illegal behavior is complicated in the characteristics of the embodied most incisive, reflects the contract law and tort law of both the independent and mutual penetration, complement each other. |
