| 摘 要： | 对行政审判权性质的认识是进行行政审判体制改革的前提，行政审判权既具有审判权的一般属性，又有自身的特殊性。其一般性表现在它的中立性、消极性、终局性上，其特殊性表现在它的政治性、监督性、适度性上。
