| 摘 要： | 在经济全球化与法治建设的要求下，国际经济法的“宪政”理论受到了学术界的广泛重视。国际经济法“宪政理论”的理论基础也存在诸多局限。在承认国际经济法“宪政”理论的积极学术意义的前提下，必须正确认识到该理论自洽性的不足，以及在制度构建中所面临的现实困境。

The theory basis of constitution existed much localization in international economic law. We should admit its active means. However, we have to realize its shortage and faced with the difficulties in institution construction. |
