| 摘 要： | 他山之石,可以攻玉。奥地利《行政罚法》相对我国《行政处罚法》来说较为完备、系统,特别是该法在适用效力、管辖权的竞合、简易程序的适用条件、处罚的裁量及执行等方面的立法更为细致周全,且有较强的操作性。因此,有必要借鉴奥地利的行政处罚立法,对我国《行政处罚法》予以修订和完善。

| Abstract: | The Administrative Punishment Law of Austria is more complete and systematic than the Administrative Punishment Law of China in that its legislation of applicable effect,concurrence of jurisdictions and applying conditions of simple procedure as well as the adjudication and execution of punishment are more comprehensive and delicate.In addition,it's more practicable.Therefore,it's necessary to learn from the legislation of the Administrative Punishment Law of Austria for the sake of revising and perfecting our country's administrative punishment law. |
