对“依法治警”之探讨

依法治警是依法治国的重要组成部分 ,是行政法治原则在公安行政管理领域的具体体现 ,是指警察权必须由法律授权并依法律规定行使。警察权的性质是行政权 ,而非司法权。对警察权的控制 ,应在治安行政领域适当分解其行政职能 ,贯彻司法控制原则 ,并保证警察权的独立行使 ;在刑事侦查领域 ,实行检警一体化和司法控制

On Ruling the Police Legally

Ruling the police legally is an important constitutional part of ruling the nation regally. It is also the concrete presentation for administrative principle of rule of law in public security's administrative fields, and it defines that police rights should be legally authorized and exercised. The nature of police rights is administrative rights, but not judicial ones. To control the police rights, we should properly separate its administrative function in the public security administrative field, follow the judicature-control principle, ensure the independent exercise if police rights, and implement an organic whole of procuratorate and police and judicial control in criminal investigative field.
