试论证券投资者权益保护法律制度

保护证券投资者权益是发展证券市场的一个永恒主题。由于多方面的原因 ,中国证券市场对投资者保护很不充分。在目前形势下 ,为实现社会公平 ,维护资本市场的安全 ,重新建构投资者权益保护法律制度不仅有必要 ,而且很迫切。应从三方面着手 :修改相关法律 ,强化证券民事责任 ;赋予投资者结社权 ,设立投资者保护基金 ;突破现有诉讼机制 ,建立经济诉讼

On Legal System of Protecting the Rights and Interests of Stockholder

Protection of the rights and interests of the stockholder becomes an eternal subject of the development of the securities market, but it is not quite thorough for some things. At present stage, it is urgently necessary to re-form the concerned legal system to obtain the social fairness and to maintain the security of the capital market. Consequently, the following should be considered: 1. amend the concerned laws ; 2. endow the stockholders with right to form association; 3. break through the established procedural system to set up a new one.
