人工智能产品发展风险抗辩后的损害救济分摊机制研究

摘    要:我国既要加大人工智能产品的研发和应用力度,最大程度激励人工智能产业发展之巨大潜力,又要预判人工智能产品带来的挑战及其风险。因此,需要根据人工智能产品的特点变革我国产品责任制度,以最大限度防范、降低和合理分配人工智能产品发展风险,尤其是需要完善人工智能产品发展风险抗辩后的损害救济分摊机制。对此,我国必须贯彻"共享—分摊"的损害救济理念,确保在国家、社会、生产者、设计者和消费者之间合理分摊损害,以更好维持各方权益的整体平衡,维护社会主义市场经济秩序并最终促进人工智能产业的高质量发展。

Abstract:China should not only strengthen the research and development and application of artificial intelligence products to stimulate the development potential of artificial intelligence industry to the greatest extent, but also anticipate the challenges and risks brought by artificial intelligence products. Therefore, it is necessary to reform the product liability system in China according to the characteristics of artificial intelligence products, so as to prevent, reduce and reasonably distribute the development risk of artificial intelligence product liability to the greatest extent, especially to improve the damage relief allocation mechanism after the development risk defense of artificial intelligence products. In this regard, China must implement the concept of "sharing-apportion" damage relief, ensure the reasonable allocation of damage among the state, society, producers, designers and consumers, so as to better maintain the overall balance of rights and interests of all parties, maintain the order of socialist market economy and ultimately promote the high-quality development of artificial intelligence industry.
