村民自治权的私法救济--一种考察视野和研究范式的转换

目前,公法学科实现了对村民自治法律问题的学术垄断,而公法学者也已成为该学术领域的守护神.在学术探讨的语境下,这种情况势必会形成研究进路的"路径依赖",从而影响理论研究的广度和深度.公法学科对村民自治的垄断直接导致村民自治权利司法救济资源的缺失.要摆脱此种学理和实务困境,可将考察视野和研究范式进行转换--在私法的视野中研究、解析乃至重构村民自治的法律制度体系,并寻求到村民自治权利的私法(司法)救济体系.

The Study on Private Law Relief for Village Self-governance--A transformation of review horizon and study method

Now the public law subjects have monoplied the study on self-governance,and the public law subjects scholars have alse come be the tutelaris.This circustance will lead to the path dependence,so the study's width and depth are affected.And the academic monopolization resulted in the scarcity of the private law relief for self-governance.To resolve it,we should transform the review horizon and study method:study,parse,reconstruct the law system of self-governance in private law,so we can find the private law (judicial)relief system.
