| 摘 要： | 攀供是指共犯或有牵连关系的犯罪嫌疑人、被告人对本案被告人的揭发.根据刑事诉讼法第46条的有关规定,无论共犯攀供被理解为证人证言,还是犯罪嫌疑人、被告人供述和辩解都存在一定的问题.因此,我们可以借鉴其他国家和地区的做法来设计、改造攀供制度,明确地规定共犯攀供的使用规则,协调理论与实践的矛盾.

| Abstract: | Implicating others in a confession means that the criminal suspect or the accused,who have a complicating relation with the crime, disclose other accused of this case.According to the criminal proceeding code 46,whether it is explained to testimony or confession and exculpation,there are some matters.We should use some modus of the other countries and areas for reference to design and rebuild our system of implicating others in a confession.We should ordain the using rule definitely to correspond the theory and the practice. |
