转型期乡村社区情理与法治秩序的建构

法治秩序在乡村的建立是依法治国的必然要求,但是社区情理的普遍存在是转型期乡村社会的客观现实,无法撇开社区情理来谈论乡村的法制建设。转型期社区情理的特点有利于送法下乡,送法下乡要求打破城乡二元的社会管理体制,加强乡村程序理性的建设。

The Sensibility and Rationalization of the Rural Community at the Transforming Period and the Building of the Order Ruled by Law

It is demanded by the principle of running the country by law to build the order ruled by law in the countryside. However, it is impossible to discuss the legal construction of the rural areas without considering the sensibility and rationalization of the community, which is the commonly existing social reality in the transforming period of the society. The characteristics of such sensibility and rationalization are in favor of our popularization of law in the countryside, which requires the breaking through of the two social administration systems in both urban and rural areas and the reinforcement of the construction of the rational order in the rural areas.
