试论两岸经济合作框架协议中的贸易救济安排

2010年6月,大陆海协会与台湾海基会正式签署了《海峡两岸经济合作框架协议》（下称ECFA）。ECFA在性质上虽然与一般性的区域贸易协定有所不同,但贸易救济措施同样是双方谈判过程中重点讨论的问题。从ECFA现有相关条款及台湾方面的立场来看,似乎倾向于采行重申和保留与WTO规则一致的反倾销、反补贴及保障措施的制度设计。实际上,基于两岸经济关系的特殊性,ECFA若对WTO贸易救济规则适度强化更符合两岸经济发展的需要。
