摘    要:在市场经济条件下,维护职工合法权益既是工会的基本职权,也是工会的基本职责。2008年1月1日实施的《劳动合同法》,赋予工会平等协商权、提出异议权、集体合同签约权、申请仲裁、提起诉讼的权利和监督权等五个方面的职权。工会的这一职权体系是一个整体,但这些规定也存在许多不足,需要进一步加以健全与完善。

Abstract:In the market economy the basic duty of the trade union is to safeguard the workers' legal fights. The labor law enacted in Jan. 1^st 2008 endued the equal negotiating fight, the fight to hold an opposite opinion, the fight to collective signed contract, the fight to apply the arbitration, the fight to litigate, and the fight to supervise, to the trade union. The governing system of the trade union should be considered as a whole. We have to perfect the system.
