| 摘 要： | 网络技术措施使得著作权合理使用制度在网络环境下遭遇前所未有的挑战。即使在网络空间,合理使用制度仍然存在法哲学、经济学、宪法学等层面上的合理内核。为此,要对传统的合理使用制度作一定的修订,使其作为著作权人和社会公众利益的平衡器能在网络空间继续发挥效力。

| Abstract: | The fair dealing system of copyright in network is facing to the challenge that hasn't happened before with the developing of network technology.However,even in cyberspace,the fair dealing of copyright has its rational core on the basis of jurisprudence,economics and constitution etc.Therefore,the traditional fair dealing system needs amending in certain parts so that it can remain active in span-new cyberspace like the equilibrium machine between the interest of copyright holders and common users. |
