析单位犯罪侦查中的几个问题

在侦查过程中,应当根据单位犯罪区别于自然人犯罪的特征来认定单位犯罪。认定犯罪嫌疑单位,在涉及单位和单位分支机构的情况下,应当根据分支机构是否独立实施犯罪而确定。犯罪嫌疑单位诉讼代表人的确定,应当由犯罪嫌疑单位根据一定规则来确定。单位犯罪案件侦查的地域管辖,应当根据刑事诉讼法的规定并参照《公安机关办理刑事案件程序规定》加以确定。
