民事诉讼费用制度若干问题研究

在走向法治的时代,诉讼费用制度是否健全严重影响着民众对法院以及法律的信赖。然而,作为民事诉讼 法的重要组成部分,诉讼费用制度在我国长期以来并未得到学界的重视。本文拟通过对诉讼费用的构成、征收、救 助、担保以及诉讼费用的管理几个方面的探究以寻求完善我国诉讼费用制度的道路。

The Discussion of the Problems of the System of Civil Litigation Expense

In the process of becoming a legal state, the integrity of the system of litigation expense seriously influences the social members' trust in the court and law. However,as the main part of the civil procedure law, the system of litigation expense hasn't been valued for quite a long time by the jurisprudential circle. The present author wishes that by discussing the composition、collection、salvage、security and management of the litigation expense, we could find a good way to perfect the current system of litigation expense in our country.
