浅析“辨认欠客观”问题成因及解决路径

刑事辨认是发现案件线索、确认犯罪嫌疑人的重要手段之一。辨认手段、辨认结论能否发挥作用,取决其客观性之高低。目前我国的刑事辨认在立法上和实践上存在着制度建构粗陋、辨认成本溢于收益、证据地位模糊、权利保障欠缺及监督制约失衡等问题,导致辨认欠客观问题产生。因此,应从增设辨认方法规则、设置证据运用规则、建立辨认权利保障体系及网络化辨认陪衬者数据库等路径着手,推进辨认欠客观问题的解决。

Analysis on the Cause and Solution of "Less Objective Identification"

Criminal identification is one of important way of finding cases clues and confirming suspects.Whether identification ways and identification conclusion will play important role depends on their objectivity.At present,there are something wrong with criminal identification in our legislation and practice such as humble systematic construction,identification cost overflowing interests,ambiguous evidence position,the lack of right assurance and the imbalance of supervision constraint,which causes less , objective identification. So the problem should be solved by increasing principles on identification method, setting principles on evidence application building right assurance system of identification and internet database of the foil persons.
