告知义务是保险法规定的一项重要义务 ,在性质上属于先合同义务 ,其立法基础应从技术和制度两个层面去认识。告知义务人不仅包括投保人 ,还应包括投保人的代理人和被保险人。我国对告知义务的内容采用询问回答主义 ,采取口头或书面方式均可 ;告知义务的履行期为投保人提出投保要求至保险合同成立这一时间内 ,行为人违反告知义务的 ,保险人享有合同解除权

On the Obligation of Representation in Law of Insurance

Representation is an important obligation in Law of Insurance , which has a character of pre-contract obligation.Its legislative foundation should be analyzed from technology and system aspects. The obligor includes not only insurance applicant ,but also its agent and the insured .In china, representation adopts ask-answer doctrine and both writing and oral forms are permitted.The deadline for performance of representation should be from the time when an insurance applicant puts forward an insurance claim to the time when the contract of insurance is established.If an obligor violates the obligation of representation ,the law of insurance entitles the insurer the right of terminating the contract of insurance.
