| 摘 要： | 2012年10月26日,全国人大常委会对《监狱法》的7个条款进行了修改,以保持和《刑事诉讼法》相关规定的一致性。因应性修改存在诸多方面的问题。《监狱法》在中国特色法律体系中的定位是行政法,《监狱法》修改应回应18年来累积的制度要求,合理配置法律主体的权利义务关系,为权利设计救济途径是当务之急。当前已具备《监狱法》修改的政治法律条件。

| Abstract: | On October 26,2012,7 terms of The Prison Law have been modified by the Standing Committee of the National People’s Congress in order to maintain the consistency with the relevant provisions of The Criminal Procedural Law.The change with response feature has many problems.The location of The Prison Law is administrative law in legal system with Chinese characteristics,the prison law amendments shall respond to eighteen years of accumulation of system requirements,make reasonable allocation of legal rights and obligations,and it is a priority to design relief way for the right.The political legal conditions have come into being for the prison law modification. |
