法家重刑主义思想之反思

法家思想是披着法治外衣的专制思想,本质上是将法律作为统治工具,用严刑峻法来推动这种专制工具的运转,达到维护君主统治的目的。中国古代的法律思想和制度深受法家思想的影响。在现代法治建设过程中应当谨防在法治的名义下行专制事实,治国不能用重典,刑罚的设置上应当随着社会的发展逐渐宽缓化。
