民法法典化的政治向度与核心价值之实现

据考察,民法典的编纂几乎总是在一定的政治因素的刺激之下浮出水面,而民法法典化之形式与实质价值的实现,也总是受制于一定的社会政治文化条件。虽然目前中国的民法法典化呼声很高,但我们必须清醒地认识到,我们尚不具备制定民法典的思想积淀和学术准备,更缺乏民法典发挥其内在价值的社会土壤,因此,在当前政治稳定、立法权统一的情况下,我们不应该急于制定一部民法典,而应该更深入地进行基础性的研究。

The Political Dimension of Codification of Civil Law and the Realization of Core Value of Civil Code

According to relevant documents,we can find that the codification of civil law had been carried on almost partly by some special political factors,and that the realization of formal value and essential value of Civil Code always be restricted by certain social environment.Although many people argue that we should compile our Civil Code right now,we must soberly realize that we have no sufficient thought accumulation and academic preparation to compile our Civil Code,and that we are short of the social environment in which the Civil Code can display its internal value.So,we should not urge to compile a Civil Code,instead,we should focus on further fundamental research.
