| 摘 要： | 在构建和谐社会的背景下,党和国家提出以构建和谐刑事司法为目标的宽严相济刑事政策。宽严相济的刑事政策是我国刑事基本政策的调整与发展,与以往的惩办与宽大相结合、＂严打＂刑事政策相比,有着更全面协调的科学内涵,体现了社会利益、集体利益和个人利益的统一,法律效果与社会效果的统一,宽、严、济的统一,打击犯罪与保护人权的统一。
