| 摘 要： | 古今中外,无数思想家对法律与道德之关系这一问题进行过研究,却均没有给出令人信服的答案。笔者认为,分属于不同法律部门的法律规则与道德间有着不同程度的关联,从整体法角度来探寻法律与道德之间的关系几乎是不可能的。想要更为清晰地认识这一问题,须从各个部分法的角度分别进行解读,而刑事法视角无疑是一个很好的选择。借此视角,我们会发现,道德与刑事法律之间的联系较一般法律更为紧密,法律与道德间联系的紧密程度则取决于法律反映终极规范的实际需要。
