| 摘 要： | 未成年人是一个国家的希望和未来,针对未成年人犯罪有着自己特殊性,因此对于未成年人与成年人共同犯罪的案件应该分案起诉。本文在阐述分案起诉的涵义和必要性的基础上,从分案处理的标准和具体程序两个层面对我国分案起诉制度的改革和完善提出了立法建议。

| Abstract: | The minor is the hope and future of a country,and the minor crime has his own characteristic,therefore minors in a case of joint crime with adult division should be prosecute divided.This paper elaborates the meaning of division of prosecution and the necessity for our country,and sets forward legislative proposals to the division of prosecution of specific standard and procedures. |
