| 摘 要： | 在过失相抵规则的适用过程中，关于监护人未履行监护职责时能否适用过失相抵，理论与实践一直存在争议。在未成年受害人有辨识能力的情况下，应肯定未成年人的过失相抵能力，承认他们可以以自己的过失与加害人的过失相抵。否定加害人的过失与监护人的监护过失相抵的司法惯例。

| Abstract: | During the application of the rule, contributory negligence, there have always been disagreements, in both theory and practice, on whether it is suitable to apply the rule when guardians fail to fulfill their responsibilities. When teenager victims are able to distinguish the right from the wrong, we should approve their contributory negligence ability, confirm that their faults can be balanced with the inflictors＇ faults and thus deny the judicial converition that the inflictors＇ faults can be balanced with the guardians＇. |
