| 摘 要： | 民间法具有其自身的局限性,主要表现在以下几个方面:民间法自身规范有效性上的局限,农村和城市生活情境变迁带来的民间法作用的局限,民间法在地域上的局限性。因此,我们一方面应当看到民间法对于法治建设的积极意义和重要地位,另一方面也必须清楚,民间法存在着自身的缺陷,我们既要重视民间法,也不能过高看待和评价它。

| Abstract: | The folk law has its own limitation which mainly includes: the limitation of validity of its regulations,the limitation of folk law brought about by the life vicissitudes of the country and city and the regional limitation of the folk law.Therefore,on one hand,we should admit the positive meaning and important status of folk law in the ruling-by-law construction;on the other hand, we should also know that it has its own defects.So we should not only attach importance to it but also appraise it properly. |
