政府购买公共服务的范围探讨

政府供给职能的民营化,促进了政府采购公共服务这一模式的发展,公共行政、服务型政府,公私合作等概念深入人心。采购时遇到的首要问题就是哪些公共服务应当纳入采购的范围,在实践中采购需求难以科学界定。目前各地虽有一些规范性文件规定了采购范围,但是位阶较低,效力较弱。各地市应当在购买公共服务的过程中,通过基本原则的指引,比例原则的适用,及程序制度的有效运作来规制公共服务的购买范围。

The privatization of government supply function promotes the development of government purchase of public services, the conception of public administration, service-oriented government and public-private partnership looks so deeply into the human mind. The first question we meet in purchase is how to define the scope scientifically. Although some regulating documents have been made, their legal rank is relatively low and effectiveness is weak. So the government should follow some basic principle, apply proportion principle and procedure system in a flexible way.
